Terms and definitions<\/strong><\/p>\n

 <\/p>\n

1)<\/i> Administration:<\/i> representatives of the portal<\/i> https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

2) Site: a set of web resources located on the Internet in the domain <\/i>https:\/\/scandard.com\/<\/i><\/a> and its third-level subdomains.<\/i><\/p>\n

3)<\/i> SCANDARD Mobile application: a mobile application placed in the Apple Store and GooglePlay<\/p>\n

4) User: any person who has registered on the site <\/i>https:\/\/scandard.com\/<\/i><\/a> and<\/i> in the Mobile application and who has entered into this agreement.<\/i><\/p>\n

5) Content: photos, videos, audios, graphic and text materials posted by the Administration.<\/i><\/p>\n

6) Registration on the site: creating a user account in the form of a set of conditional identification data of the User, through which the User accesses the Site.<\/i><\/p>\n

7) Personal account: a part of the closed area of the Site, where the information about the User is placed.<\/i><\/p>\n

 <\/p>\n

General Provisions<\/strong><\/p>\n

The current User Agreement is designed to regulate the relationship between https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application and the User who uses the functionality, tools and services of the site https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

By registering at https:\/\/scandard.com\/<\/i><\/a> and in the SCANDARD Mobile Application, or in any other way using the functionality, tools and services of https:\/\/scandard.com\/<\/i><\/a>\u00a0 and the SCANDARD Mobile Application, the person guarantees that he\/she is familiar with the terms and conditions of the Agreement and that he\/she fully and unconditionally accepts the terms and conditions of this Agreement. This Agreement may be amended or supplemented by the Administration at any time by posting (publishing) a new version. The Administration informs the User about changes and amendments to the Agreement in any of the following ways: by publishing on the Site and in the SCANDARD Mobile Application, including via email to the User’s electronic address.<\/p>\n

 <\/p>\n

Upon receipt of such notice, the User undertakes to immediately read about the changes and amendments to the Agreement. The User’s continued use of the resources https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application after receiving a notification of changes and amendments to the Agreement is an expression of the User’s agreement with them. The User uses https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application at their own discretion. Services on the website https:\/\/scandard.com\/<\/i><\/a> and in the SCANDARD Mobile Application are provided on an “as is” basis, i.e. the User is not guaranteed that the Site, as well as the options and services offered within https:\/\/scandard.com\/<\/i><\/a> and in the SCANDARD:<\/p>\n

1) will function uninterruptedly, continuously, without errors;<\/i><\/p>\n

2) will meet the requirements and expectations of the User.<\/i><\/p>\n

 <\/p>\n

Due to the specificity of the Internet, the Administration will make every effort to ensure that the software located on the website https:\/\/scandard.com\/<\/i><\/a> and in the SCANDARD Mobile Application does not cause any damage to your property. However, we cannot\u00a0 guarantee security Site https:\/\/scandard.com\/ and the SCANDARD Mobile Application one hundred percent, so the Administration is not liable to the User for any damage caused to the User, including his computer, software or other property in connection with use or inability to use the Site and the Mobile Application.<\/p>\n

 <\/p>\n

Subject of the Agreement<\/strong><\/p>\n

The Site https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application offer the User their service on the terms and conditions that are the subject of this Agreement. The Site https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application reserve the right to change this Agreement at any time without any special notification. If the User continues to use the services of the website https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application after the changes to the Agreement are published, it is considered that the User thereby accepts changes to the terms of the Agreement.<\/p>\n

Description of the services of the Site https:\/\/scandard.com\/ and the SCANDARD Mobile Application<\/p>\n

The terms used in the text of the Agreement have the following meaning:<\/p>\n

Site: website https:\/\/scandard.com<\/p>\n

Administration: website administration<\/p>\n

User: a person who views information on the site and\/or uses a mobile application.<\/p>\n

Services: interactive services of the mobile application and the system<\/p>\n

Manufacturer’s Area: a closed part of the website, available only to the system members<\/p>\n

System member: a manufacturer or partner registered in the system<\/p>\n

Agreement: this agreement and the rules of use of the site https:\/\/scandard.com\/<\/p>\n

Please read these terms carefully before viewing this site. If you do not agree to these terms, do not use this site.<\/p>\n

Use of this site, including filling out forms, subscribing to the newsletter of this site means your consent to the terms of this Agreement.<\/p>\n

 <\/p>\n

Description of services<\/strong><\/p>\n

The Site https:\/\/scandard.com\/ is an information resource that provides information about services and company news and allows the User to contact the administration using the feedback form.<\/p>\n

All users can view the content of the Site, read information and materials, as well as other data posted on it.<\/p>\n

Manufacturer’s Area: after registering in the system and concluding a service agreement, each registered participant receives a personal hyperlink to the Manufacturer’s Area on the website https:\/\/scandard.com\/; registration of new participants in the system is performed by the administration of the service only.<\/p>\n

The Manufacturer’s Area is designed for manufacturers of goods and services, or service partners. The Manufacturer’s Area allows the system participant to initiate the issuance of unique labeling codes for their products, control the life cycle of each unit of production, receive general and\/or detailed analytics on movement and change of the status of the goods, etc.<\/p>\n

 <\/p>\n

Mobile Application: a free service available for free download for all users<\/p>\n

The Mobile Application supports Android and iOS mobile platforms, the applications are available for download in Google Play Market – for Android, and Apple AppStore – for iOS.<\/p>\n

The mobile application allows the user to identify products marked with unique scandard codes, check the originality of the purchased product (products of all registered participants of the system \/ manufacturers), leave feedback on the product, which can be seen by the manufacturer directly in the Manufacturer’s Area.<\/p>\n

Services provided by the Mobile Application are available only after registration in the system.<\/p>\n

 <\/p>\n

By registering in the system, the User agrees to the use and processing of their personal data.<\/p>\n

The source of personal data collection is information provided directly and voluntarily by the User.<\/p>\n

In case of providing inaccurate information when registering in the application, or other violation of these rules, the User may be denied the use of services.<\/p>\n

The user is personally responsible for saving their login and password and other login details to log in to the application.<\/p>\n

The user confirms that he is familiar with all the clauses of this agreement and unconditionally accepts them.<\/p>\n

Duration of the Agreement<\/p>\n

 <\/p>\n

The Agreement is considered to have entered into force and accepted by the User after marking (ticking) the consent in a special field next to the phrase “I accept the terms of the Agreement and Privacy Policy” when registering on the Site.<\/p>\n

 <\/p>\n

User obligations at registration, password and security<\/strong><\/p>\n

To use the services of the Site https:\/\/scandard.com\/<\/i><\/a>\u00a0 and the SCANDARD Mobile Application, the User must go through the registration procedure on the Site and\/or in the Mobile Application. For this purpose the Used has to:<\/p>\n

1) fill in the Registration Form;<\/i><\/p>\n

 <\/p>\n

2) agree with the terms of the User Agreement, as described in the section “Entry into force of the Agreement” of this Agreement.<\/i><\/p>\n

 <\/p>\n

Upon registration, the user must provide reliable, accurate and complete information about themselves on the issues specified in the Registration Form. This information is kept up to date in the User’s Personal Account. If the User provides incorrect information or there are serious grounds to believe that the information provided by the User is incorrect, incomplete or inaccurate, the Site https:\/\/scandard.com\/<\/i><\/a>\u00a0 and the SCANDARD Mobile Application are entitled to suspend or cancel the User’s registration and deny the User use of its service.<\/p>\n

At the end of the registration process, the User receives a login (equivalent to the User’s e-mail address) and a password to access his\/her Personal Account. The User is responsible for the security of his\/her login and password, as well as for everything that will be done on the Site https:\/\/scandard.com\/<\/i><\/a>and in the SCANDARD Mobile Application under the User’s login and password.<\/p>\n

The Site https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application have the right to prohibit the use of certain logins and\/or withdraw them from circulation. The User agrees that he\/she is obliged to immediately notify https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application of any case of unauthorized (not allowed by the User) access with the User’s login and password and\/or of any security breach, as well as the fact that the User finishes his\/her session on his\/her own, under his\/her password (“Exit” button) after the end of each work session with the services of the Site https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application. https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application are not responsible for possible loss or damage to data that may occur due to the User’s violation of the provisions of this part of the User Agreement. The User has no right to register in the system more than once.<\/p>\n

 <\/p>\n

Behavior of the registered User<\/p>\n

The User agrees not to use https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application for:<\/p>\n

 <\/p>\n

1) downloading, sending, forwarding or any other means of publishing materials, including through Web-forms that are illegal, harmful, threatening, morally offensive, defamatory, copyright infringing, hate speech or \/ or discrimination of people promoting hatred and\/or discrimination against people on the basis of race, ethnicity, sex or social status;<\/i><\/p>\n

2) violating the rights of minors and\/or causing them harm in any form;<\/i><\/p>\n

3) restricting the rights of minorities;<\/i><\/p>\n

4) impersonating another person or a representative of an organization and\/or community without sufficient rights, as well as misleading as to the properties and characteristics of any subjects or objects;<\/i><\/p>\n

5) downloading, sending, forwarding or publishing in any other way, including through Web-forms and during participation in public opinion polls, of materials which the User has no right to make available in accordance with the law or under any contractual relationship;<\/i><\/p>\n

6) downloading, sending, forwarding or publishing in any other way,<\/i> including through Web-forms and during participation in public opinion polls, of materials <\/i>that affect any patent, trademark, trade secret, copyright or other property rights, and\/or copyright and related third party rights;<\/i><\/p>\n

7) downloading, sending, forwarding or publishing in any other way,<\/i> including through Web-forms and during participation in public opinion polls, of specially permitted advertising information, spam, schemes of \u201cpyramids\u201d, \u201cletters of happiness\u201d (<\/i>https:\/\/scandard.com\/<\/i><\/a>\u00a0and <\/i>SCANDARD Mobile Application uses the features of the Web interface <\/i>https:\/\/scandard.com\/<\/i><\/a>\u00a0and SCANDARD Mobile Application for advertising. The User of <\/i>https:\/\/scandard.com\/<\/i><\/a>\u00a0and <\/i>SCANDARD Mobile Application undertakes NOT to carry out mass advertising mailings, addressed to more than ten recipients, unauthorized and\/or unexpected recipients, as well as repeated unauthorized mailings to one recipient. Email messages <\/i>https:\/\/scandard.com\/<\/i><\/a> addressed to users and the content of organizational and technical information about <\/i>https:\/\/scandard.com\/<\/i><\/a> and <\/i>SCANDARD Mobile Application are not considered spam);<\/i><\/p>\n

8) downloading, sending, forwarding or publishing in any other way of any materials, including through Web-forms and during participation in public opinion polls containing viruses or other computer codes, files or programs intended for violation, destruction or restriction of functionality of any computer or telecommunication equipment or software, for unauthorized access, as well as serial numbers to commercial software products and programs for their generation, logins, passwords, etc.: means to obtain unauthorized access to paid resources on the Internet, as well as the placement of links to the above information;<\/i><\/p>\n

9) intentional or accidental violation of any applicable local, state or international laws;<\/i><\/p>\n

10) collection and storage of personal data of other users;<\/i><\/p>\n

11) unauthorized sending, transmission, including through Web-forms, electronic messages of advertising, commercial or propaganda nature;<\/i><\/p>\n

12) sending or transmitting, including through Web-forms, of rude and offensive expressions and suggestions;<\/i><\/p>\n

13) sending or transmitting, including through Web-forms, of pornographic texts and other materials.<\/i><\/p>\n

 <\/p>\n

If the User violates the above rules, https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application have the right to suspend or cancel the User’s registration and deny the User the use of their service.<\/p>\n

 <\/p>\n

Before deciding to cancel the User’s registration, https:\/\/scandard.com\/<\/i><\/a>\u00a0and SCANDARD Mobile Application will send the User a written warning to their e-mail address specified during registration in the project https:\/\/scandard.com\/<\/i><\/a> and SCANDARD Mobile Application.<\/p>\n

 <\/p>\n

Removal of the User from the database will take place in case if facts of violation of this clause of the Agreement, committed after sending a written warning, are detected.<\/p>\n

Non-commercial use<\/p>\n

 <\/p>\n

The User agrees not to reproduce, duplicate or copy, sell or resell, or use for commercial purposes any part of the service https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application, except when such permission is given to the user of https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application. https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application are not responsible for any agreements between the User and third parties.<\/p>\n

 <\/p>\n

Termination of User Registration<\/p>\n

The User agrees that https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application may block or cancel the User’s registration if the User is convicted (by court order, as a result of an out-of-court investigation, as well as in other ways) of illegal activities related to the WEB-site https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application on the Internet. https:\/\/scandard.com\/<\/i><\/a> and SCANDARD Mobile Application have the right to issue a warning, as well as temporarily or indefinitely block the registration of the User for the Services, in case the User violates the terms of this Agreement. The User also agrees that https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application are not responsible for terminating the User’s access.<\/p>\n

 <\/p>\n

The user has the right to terminate the relationship with https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application and to refuse registration using the special interface according to the instructions. In this case, the User’s Personal Account will be deleted.<\/p>\n

 <\/p>\n

https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application have the right to terminate the relationship with the User in case the latter violates this Agreement.<\/p>\n

 <\/p>\n

In case of repeated violation by the user of this Agreement https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application reserve the right to deny the latter the opportunity to use the service https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application for up to three years.<\/p>\n

https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application reserve the right to temporarily suspend or terminate the provision of services of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application by notifying the user in a timely manner.<\/p>\n

Property rights of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

 <\/p>\n

The User acknowledges and agrees that the software is protected by copyright, trademarks, patents, intellectual property laws and other relevant Ukrainian and international laws.<\/p>\n

 <\/p>\n

https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application grant the User the personal non-exclusive and non-transferable right to use the software provided in the service, on one computer, provided that neither the User nor any other person with the assistance of the User will not copy or modify the software; create software-derived programs; penetrate the software in order to obtain program codes; sell, assent, lease, transfer to third parties in any other form the rights in relation to the postal service software provided to the User under the Agreement, as well as modify the postal service, including in order to obtain unauthorized access to it.<\/p>\n

 <\/p>\n

The information transmitted to the User belongs to its legal Owner. By using https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, the User does not acquire rights to the information provided to him\/her. By participating in the SCANDARD project, the User agrees to maintain strict confidentiality and not to disclose to third parties information obtained during the use of the service of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

Exemption from guarantees<\/p>\n

 <\/p>\n

The User understands and agrees that:<\/p>\n

 <\/p>\n

1) The User uses <\/i>https:\/\/scandard.com\/<\/i><\/a> and the <\/i>SCANDARD Mobile Application at his\/her own risk. The service is provided “as is”. <\/i>https:\/\/scandard.com\/<\/i><\/a> and the <\/i>SCANDARD Mobile Application do not assume any responsibility, including for the compliance of the Service with the purpose of the User;<\/i><\/p>\n

2) <\/i>https:\/\/scandard.com\/<\/i><\/a> and the <\/i>SCANDARD Mobile Application does not guarantee that: the service will meet the requirements of the User; the service will be provided continuously, quickly, reliably and without errors; the results that can be obtained using the service will be accurate and reliable; the quality of any product, service, information and other received using the service will meet the expectations of the User; all errors in the programs will be corrected;<\/i><\/p>\n

3) The User may use at his own risk any materials received by the User using the service of <\/i>https:\/\/scandard.com\/<\/i><\/a> and the <\/i>SCANDARD Mobile Application, the User is responsible for any damages that may be caused to the User\u2019s computer and the User’s data as a result of downloading these materials;<\/i><\/p>\n

4) <\/i>https:\/\/scandard.com\/<\/i><\/a>\u00a0and the <\/i>SCANDARD Mobile Application are not responsible for any direct or indirect damages caused by: use or inability to use the service; unauthorized access to the User’s communications; statements or behavior of any third party in the service.<\/i><\/p>\n

Privacy of https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application<\/p>\n

 <\/p>\n

As part of the operation, https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application ensure the confidentiality of information about Users of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, except as provided by the legislation of Ukraine.<\/p>\n

 <\/p>\n

The User agrees to the use of personal information by https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application. You can find out more about the protection of Users\u2019 personal information in the Privacy<\/a> Policy\u00a0https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

Information filtering<\/p>\n

 <\/p>\n

The user was also informed of and he\/she agrees that the information sent by him\/her undergoes certain automatic processing by the programs of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile application for full transmission, reception and storage of such information. Mandatory automatic processing includes the necessary set of measures to detect malicious codes in the transmitted information, as well as, if possible, to block or delete them (depending on the complexity of this code and the capabilities of the software https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application). These measures are taken solely to protect the personal computers of the User of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, as well as to reduce the load on the equipment of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

Principle of respect for the rights of Internet users<\/p>\n

https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application and their Users respect the rights of third parties, adhere to the established traditions and ethics of the Internet, do not abuse the capabilities of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application for purposes contrary to moral norms and morality.<\/p>\n

 <\/p>\n

Breaks in the provision of services https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application<\/p>\n

 <\/p>\n

https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application has the right to carry out preventive works in the software and hardware complex of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application with temporary suspension of work. https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application notifies Users of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application for a certain time before such works start, indicating the time of their completion. The notification can be made through the User\u2019s Personal Account or through the news on the website https:\/\/scandard.com\/<\/i><\/a> and in the SCANDARD Mobile Application.<\/p>\n

 <\/p>\n

In case of force majeure, as well as accidents or failures in the software and hardware complexes of third parties who cooperate with https:\/\/scandard.com\/<\/i><\/a> and the the SCANDARD Mobile Application, or actions of third parties aimed at suspending or terminating the operation of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application functioning may be terminated without prior notice to users.<\/p>\n

Procedure for consideration of claims<\/p>\n

 <\/p>\n

To resolve disputes that arise between the User and https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application as a result of using https:\/\/scandard.com\/<\/i><\/a>\u00a0and the SCANDARD Mobile Application, the following claim procedure applies.<\/p>\n

 <\/p>\n

The User who believes that his\/her rights and interests have been violated due to the actions of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, sends his\/her claim to the latter via e-mail info@scandard.com<\/a>, or through the User\u2019s Personal Account at https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

 <\/p>\n

Within 5 (five) working days from the date of receipt of the claim https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application is obliged to state its position on the main issues mentioned in the claim and send its answer to the e-mail address specified in the claim.<\/p>\n

 <\/p>\n

In case of failure to resolve the dispute by means of a claim procedure, the dispute shall be considered in accordance with the Agreement.<\/p>\n

 <\/p>\n

Anonymous claims or claims that do not allow to identify the User on the basis of the data provided by him\/her during registration shall not be considered.<\/p>\n

Changes and additions to the Agreement<\/p>\n

 <\/p>\n

Changes and additions to the Agreement shall enter into force 10 (ten) days after their publication on the website https:\/\/scandard.com\/<\/i><\/a> and in the SCANDARD Mobile Application or later, with a later date of entry into force.<\/p>\n

 <\/p>\n

The User has the right to reject additional changes to this Agreement made by https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, which means a complete and unclaimed rejection by the User of the services of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

 <\/p>\n

Innovations in the legislation of Ukraine<\/p>\n

 <\/p>\n

In case of adoption of normative legal acts by the authorities of Ukraine, which affect in whole or in part the functioning of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application reserves the right to make any changes in the operation of https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, aimed at bringing the latter in line with the new regulations.<\/p>\n

Final provisions<\/p>\n

 <\/p>\n

This Agreement enters into force upon confirmation and supersedes all previous agreements between the User and https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application.<\/p>\n

Unless otherwise agreed by an additional Agreement between the User and https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, all claims, inquiries, questions and any other correspondence must be sent to https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application by email info@scandard.com. https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application sends a message to the User to the e-mail address he\/she provided during registration on the service https:\/\/scandard.com\/<\/i><\/a> and SCANDARD Mobile Application. The message shall be deemed to have been successfully sent 24 hours after the e-mail was sent, unless the sending party has received a message that the recipient\u2019s address is incorrect. Alternatively, https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application may notify the User by registered mail with a notice of delivery, to the postal address provided by the User during registration on the service https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application. In this case, the notification should be considered sent successfully after 3 days the notification has been sent.<\/p>\n

The Agreement is a legally binding agreement between the User and https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application and regulates the User\u2019s use of the https:\/\/scandard.com\/<\/i><\/a> service and the SCANDARD Mobile Application.<\/p>\n

 <\/p>\n

The User and https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application agree that any disputes or claims arising out of or related to this Agreement shall be settled first by negotiation and, if impossible to reach an agreement, in the court of general jurisdiction in Kyiv. Each such dispute or claim shall be resolved individually and shall not be combined with any other claim or dispute made by any third party.<\/p>\n

 <\/p>\n

Due to the gratuitous nature of the Agreement, the regulations on consumer protection are not applicable to it. If the Agreement is given charge, it will be amended accordingly in order to comply with the abovementioned regulations.<\/p>\n

 <\/p>\n

Nothing in the Agreement shall be construed as the establishment of an agency relationship, partnership relationship, joint venture relationship or personal employment relationship between the User and https:\/\/scandard.com\/<\/i><\/a> and the SCANDARD Mobile Application, or any other relationship not expressly provided for in the Agreement.<\/p>\n

 <\/p>\n

The court’s recognition of any provision of the Agreement as invalid or not enforceable shall not entail the invalidity or non-enforcement of other provisions of the Agreement.<\/p>\n
